Continuing the return to Monthly TowForce Membership Lists. If your screen name appears on the List I ask that you take a moment to add a reply. Thanks for being a continuing TowForce Member.
Also, we continue to need supporters in order to bring back the monthly giveaways, attend towing events, hopefully have a return to those popular meet & greets at some point. In addition this new message board has monthly expenses and we do get or did get compensated for time. Katkiller aka Chris is continuing to covering the event costs as he has the past couple of years. It is now time we get back on a realistic budget moving forward. I will be asking for member support each month as a new member list is posted.
I want to also take this time to thank each and everyone of you for your participation and we hope to see you at a towing event in 2022. Check TowForce regularly for Industry News, Rollcalls and much more.

Is National Flag Day, show us your Flag...
It's also, National Bourbon Day.
Do you have a taste for Bourbon, if so name your Brand.
Who is ready to claim a Passport to the Bourbon Trial.
TowForce, has been working on a Bourbon Trail Tour combined with a Towing Event.
This started back before Covid Hit and was then put on hold. We're going to make it
happen, just down't know when. What we do need to know is the level of interest.
Over the next few months watch for topics related to origanizing such an event.
Any Thoughts and Don't Forget to add your Tow Truck Flag Image!

While I do not think that today the Red & Blues makes as much difference as they did years ago when the desire turn to request. I can see that even a slight advantage kight save a life. However, we cannot forget the fact that over the past year more Law Enforcement Officers have been struck and killed compared to Tow Truck operators. So, did the Red & Blues offer more protection? as well far more Police Vehicles are now being struck, would should we make of that statistic?
Back to the Red & Blue, I have my reservations as to them being only rear facing. Forward facing may be an issue. They also should not be used continuously as are the ambers.

An attorney is going to agrue the point regardless the involvement of the tow truck. In this case there would have been no way out if you were the tow truck caught up in the incident but not envolved. Even if the tow truck was involved the atty. would agree that the tow truck activated their beacon or did not activate the beacon. The Tow Truck Driver followed instructions and moved out of the roadway. My arugement would be I reported the incident and rendered aid by calling 911. I then followed the instructions given, I was not told to leave the scene as I may have been a witness.
What if the Tow Truck were to slow or stop and then leave the scene, but call it in to 911. I suppose the Tow Truck Driver would be covered. But, it is likely that an attorney may try to name the company in a law suit even though the Tow Truck had no responsiblity to stay on scene. Again, there is no situation other than not being there that would protect the Tow Truck Driver or Company from an attorney that was naming everyone they could.
Why can't we get back to the basics?

We get these from uhaul from time to time. Generally after hours there is not a number that is answered. As long as the rental agreement is correct, the officer will take down the information. That officer will then advise those in the Uhaul to find alternative transportation and impound the Uhaul Vehicle.
In this case it is a stolen plate, so the officers would likely have taken the plate and advised the renter to part the Uhaul Vehicle until they could contact the company. Uhaul doesn't seem good at keeping up with their vehicles or making sure the plate matches. We have gotten them that the plate came back to Uhaul just a different VIN. It's the same with any rental vehicle, though it is not common. Just as car theives switching License Plates on a Stolen Vehicle. Got one that the driver was arrested on other charges. The Officer took down the plate ad didn't check the VIN as it was the same type vehicle (Ford Fusion) only a year difference. That's is why we check the VIN on every impound.

I am confused by the story. Did the Tow truck Driver move his vehicle off the freeway as ordered by the 911 dispatcher?
A 911 dispatcher told the tow truck driver to move his vehicle, which was outfitted with lights, off the freeway, Fascenelli said, despite the tow truck driver arguing that doing so could lead to an accident. The crash scene was safe before the tow truck driver was ordered to move his vehicle, a decision that broke Aguilar-Calixto’s chain of responsibility, the defense attorney argued.

This is an interesting angle:
Here is what I found in regards to California, every state is somewhat different and I it is not clear concern Texas. So, I need to do some further research before commenting the state of Texas.
Failure to Render Aid:
California does not impose a duty on any member of the public to render aid to another person in an emergency. Thus, if you choose not to get involved, California law does not impose any criminal or civil liability for your inaction.
As an agrument, this would not be a protection.
Does the Good Samaritan law apply?
In California, there is no duty to rescue or assist another person who is in danger or in an emergency situation. This means that you cannot be held liable for not helping out; neither a lawsuit nor criminal charges can be filed.
As an agrument, this would open the door.
How does the Good Samaritan law work?
What is the "Good Samaritan Law" in California? California Good Samaritan law shields you from civil liability when you act in good faith, not seeking compensation, to render emergency medical or non-medical care at the scene of an emergency.
As an agrument, this would possibly provide some level of protection.
I am sure one of the Towing Publications has a past article which cover this topic of "Traffic Assistance" as a Good Samaritan.
I have never thought of a good argument for Tow Trucks to be considered First Responders. That is because it is only occasional that the Tow Truck is First on the Scene. Question is if Tow Trucks were classified as First Responders would that be a legal protection? While it may not satisfied the private companies insurnace it would likely reduce the liablity. We really need an Industry Attorney/Legal Advisor/Commentor that is willing to chime in on some of these serious discusions.
“Good Samaritan” Law at a Glance
https://www.safehighways.org/additional-resources/safe-highway-matters/spring-2010-3/good-samaritan-law/
Safety Service Patrol drivers are often the first responders to emergency situations that arise along America’s highways. The “Good Samaritan” Law aims to protect them and other first responders who help injured people during these emergency situations.
What? The “Good Samaritan” Law typically protects first responders from liability for unintentional injury or wrongful death following assistance given to another injured or ill person during an emergency situation, unless the assistance provided is deemed unreasonable or non-consensual.
Why? Due to the overwhelming tendency in the United States for civilians to pursue personal injury lawsuits, the law was designed to ensure that rescuers and bystanders could and would aid others in trouble without being fearful of an impending lawsuit.
Where? While some form of the “Good Samaritan” Law exists in all 50 states, each statute varies depending on the jurisdiction.
When? California was the first state to enact such a principle into law in 1959 when they granted immunity to doctors who give aid in emergency situations.
Who? Some states’ “Good Samaritan” Laws protect all individuals who find themselves in an emergency situation where someone requires assistance, while other states’ law only shield those who have completed basic first aid training and are certified by national health organizations. In some cases the “Good Samaritan” Law extends even to off-duty and volunteer first responders.
How? For more information on your state’s “Good Samaritan” Law please visit: http://www.cprinstructor.com/legal.htm.

Tow truck driver killed in violent collision on I-10 shoulder near Irish Bayou, NOPD says
NEW ORLEANS (WVUE) - A flatbed tow truck driver working to remove a disabled van from the shoulder of Interstate 10 was killed early Saturday (June 11) when another vehicle smashed into the van from behind, New Orleans police said.
The identity of the 50-year-old victim has not been disclosed, but police said he died at the scene of the 2:43 a.m. crash.
The male driver of a Chevrolet Silverado pickup truck that struck the disabled van sustained minor injuries. The NOPD identified him as 34-year-old Kirk Jefferson, and said he has been arrested on one count of vehicular homicide. If charged and convicted of the offense, Jefferson would face 5 to 30 years in state prison under Louisiana law.
The fatal crash occurred on the shoulder of the eastbound side of I-10 near Ridgeway Boulevard, an area known as Irish Bayou. Police said the tow truck driver was working to load the unoccupied van when Jefferson’s pickup struck the rear of the van, causing it to crash into the tow truck. The pickup left the road after the collision, coming to rest in a grassy area alongside the interstate.
The NOPD said traffic fatality detective Richard Chambers was investigating the collision. Anyone with information on the crash is asked to contact Chambers at (504) 658-6205 or Crimestoppers at (504) 822-1111.
Impaired motorist kills tow truck driver working along I-10 at Irish Bayou, police say
Victim was trying to hook up disabled van on highway's shoulder
A tow truck driver trying to hook up a disabled van along Interstate 10 was struck and killed by pickup truck early Saturday at Irish Bayou.
The New Orleans Police Department said the wrecker driver was preparing to tow the van from the right eastbound shoulder of I-10 near U.S. 11 when a Chevrolet Silverado pickup hit the rear of the van. The van crashed into the flatbed tow truck. First responders found the wrecker driver dead on the shoulder and the pickup in the grass along the highway.
The driver of the pickup, Kirk Jefferson, 34, sustained minor injuries and cooperated with investigators, police said. They booked him with vehicular homicide, a charge that incorporates driving under the influence of alcohol or drugs.
Police were notified of the wreck at 2:43 a.m.
New Orleans Police Department
UPDATE: The driver of the pickup truck involved in this crash, identified as Kirk Jefferson (pictured, black male, DOB: 08-21-1987), has been arrested on one count of vehicular homicide. He will be booked accordingly into the Orleans Parish Justice Center.
Anyone with additional information that can aid in the NOPD's investigation of a traffic fatality in the early hours today on I-10 East near Ridgeway Drive is asked to call Traffic Fatality Investigator Richard Chambers at 504-658-6205.

Conatinuing the series in Insurance, Safety & Training regarding youtubers and independent media. We are sharing this video from a knowledge based prospective. Your place of business can be subject to a similar situation. Do you premit audio, video or both in your place of business. What are the laws in your state in this regard potential issue.
In some states there are no limits in some there are control limits. This means a person cannot enter your private property with the intent to video document without expressed permission. Now, I have not researched different states in this regard. However, in this series we will attempt to indentify what rights a tow company has in regards to the private property. Public Property is another issue, such as working the scene of an accident. We continue to hear of tow truck drivers getting into a confrontation because they do not want to be recorded.
So, in the interest of both entertainment and education we recommend watching to the end.
Description by Long Island Audit:
Fellow Patriots & Freedom lovers, On June 2nd 2022 I was peacefully exercising my 1st Amendment Rights at the Law Enforcement Center located in Rome, Georgia. While recording some tax payer funded Police Vehicles in the Public Parking Garage I was confronted by three Georgia Bureau Of Investigation Agents. All three of them refused to identify themselves when asked and not only did they escalate the situation & acted unprofessional they had a grave misunderstanding of the GA Stop & ID statute. The next day I went to the GBI headquarters to try and hold them accountable…Please be sure to hit the like button, it truly helps spread this around for more Patriots to see it and I appreciate it!

Danville man punched cop, tried stealing gun, tow truck in McLean County, prosecutors say
BLOOMINGTON — An Illinois State Police trooper suffered lacerations to his face Wednesday during a violent interaction with a Danville man after a traffic stop on Interstate 55 in Chenoa Township, prosecutors said.
In court on Friday, McLean County state’s attorneys displayed a police vehicle dash camera video of the altercation in which Randy M. Turner, 39, is shown standing alongside his vehicle having a conversation with the trooper before he suddenly lowers his shoulders and tackles the officer to the ground.
Police pulled Turner’s vehicle over on I-55 after it was detected to be traveling 109 mph. The trooper notified Turner that his driver's license was expired and explained that his vehicle would be towed, that Turner would obtain a ride to the McLean County jail for a citation, and he would then be released, prosecutors said.
The video had begun with Turner waving the officer to come back toward his car. Turner and the officer spoke briefly, and then Turner tackled the trooper and attempted to take the officer’s firearm.
Turner punched the officer on the head at least three times during the physical altercation on the ground.
He obtained control of the trooper’s pepper spray and sprayed it toward the cop, at which time a motorist on I-55 pulled over and a man armed with a firearm ran toward the altercation and pointed his gun at Turner. The armed motorist possessed a concealed carry license, prosecutors said.
Turner ran onto I-55 between traffic and rushed to a tow truck that had arrived amid the incident. He climbed into the tow truck, but the police officer chased and Tased him in order to place him in custody, prosecutors said.
Turner is charged with two counts of disarming a peace officer, five counts of aggravated battery, unlawful possession of a weapon by a felon, attempted possession of a stolen motor vehicle, criminal damage to government supported property, and driving under the influence of drugs.
The DUI citation noted that Turner admitted to smoking phencyclidine, or PCP, which is a dissociative hallucinogenic drug.
McLean County State’s Attorney Don Knapp said Turner provided recorded statements to police in which he said he attacked the officer because he didn’t want to go back to jail, and he attempted to take the officer’s gun because he “wanted to control the situation, and the person with the gun was in control.”
Turner further told police that had he obtained the gun, he would have shot toward the trooper if he attempted to arrest him, prosecutors said.
Turner, who appeared in bond court Friday from a jail cell via Zoom, said, “I really did (say that)? I’m sorry, judge.”
A judge set Turner’s bond at $2 million at 10%, meaning he needs $200,035 to be released from custody.
An arraignment is scheduled for June 24.
