Tow Truck Driver Throws Hammer Down (TN)

First instinct is not a good one. Yes, I know that words like throw something in the roadway are common on social media. However, this is an action that can have negative consequences on both the person throwing the hammer an the company whose name is on the tow truck. As much as we would like to anything that results in damage even to avoid being struck can result in legal issues.

Tow Truck Driver Throws Hammer Down When Vehicle Veers Towards Him

 

An officer responded to a report of a truck driver throwing a hammer into the road on Highway 153. The officer arrived and spoke to the man who was operating a tow truck and appeared visibly shaken. He said he was working hooking up the vehicle he was going to tow and a car veered toward him and he was afraid they would hit him. He said he threw down his hammer out of fear and frustration but recovered it and was fine now.

How many times do you read a headline of “Officer cites/arrests motorist who almost killed a man working on side of the road”? I have done far worse that this guy and do not regret it.

What is your insurance carrier going to say? You have to train your operators to constantly think risk mitigation. Do you really think you have a snowflakes chance in he'll in a courtroom doing this. Your carrier is just going to cut a check.
