On December 1, 2001, tow truck driver Jesse Hernandez was struck by a Lincoln Continental while he was working a breakdown on an interstate highway in Galveston, Texas. He was killed instantly. The driver of the Lincoln who struck Hernandez (and the customer, who survived) was convicted of manslaughter and sentenced to 20 years imprisonment.

On December 15, 2005, the Texas Court of Appeals upheld the conviction.
