FAIRVIEW PARK, OH (WOIO) - Police said the driver who hit a tow truck, causing the tow truck operator to lose his leg, was three times over the legal limit.

Fairview Park police said the 35-year-old Cleveland man had a BAC of .255. The legal limit is .08.

The accident happened around 4 a.m. on March 18 at Lorain Road and West 204th Street.

According to police, the driver was going 66 mph in a 35 mph zone when he hit the tow truck, causing it to fall on top of Ronald Urbanksy, 53.

Urbanksy was in the process of towing a vehicle that was impounded after an unrelated traffic stop.

The impact of the crash caused the tow truck to fall on top of him, pinning him underneath.

Urbanksy continues to recover from the crash.

He works for Patton’s Five Star Towing and they are accepting donations on his behalf at their office, 29700 Lorain Road, North Olmsted, Ohio, 44070.

Police said charges are pending against the driver and the case has been bound over to the Cuyahoga County Grand Jury.

Police added the driver remains in the hospital.
