January 18, 2018 — On Monday, prior to the end of his term, Governor Chris Christie signed S-3459/A-5329 into law, effective immediately. The law amends the Predatory Towing Prevention Act as it applies to law enforcement tows by exempting law enforcement officers and towing companies from certain provisions of the Act.

In its previous language, it has been recently determined by the New Jersey Department of Consumer Affairs (NJDOC) that the Predatory Towing Prevention Act, passed in April of 2009, prohibited towers from charging certain fees permitted by municipal and/or state code when requested by such agency. Unfortunately, this was not one of the original intentions of the Predatory Towing Prevention Act and several towers were punished and fined by the NJDOC as a result. The new bill exempts any non-consent law enforcement officer of the State, or political subdivision of the State, who authorizes the towing of a vehicle.

All other private property towing regulations in the Predatory Towing Act remain in effect.

“The changes in the law re-establish the authority to regulate towing ordinances and operating procedures in the hands of municipal and state police” said GSTA President and Legislative Chair John Glass.

The Garden State Towing Association is the recognized towing association of New Jersey, as well as the only New Jersey state towing association affiliated with the national Towing and Recovery Association of America (TRAA) and the Conference of Northeast Towing Associations (CNTA).
