TowForce Posted December 19, 2020 Posted December 19, 2020 OK, prior to watching this guys YouTube. First, he is obviously anti law enforcement which drastically decreases is validity in my opinion. Second, the law enforcement officer seemed to be dealing with the situation in a proper manner and he resolved it without confrontation. Third, no city or law enforcement should put a tow operator or the company out there on public property without law enforcement present in the first place. The question would be now is this a public or private park. Did the city call the towing company or was this a patrol tow. Yes, it makes a huge difference and either way unless the vehicle is hooked up generally there cannot be a charge. That is unless it is a payable citation which the officer would have written if he witnessed the violation. Even if the vehicle is hooked up, all to often it is a theft of service. The officer should have stated the city ordinance and taken the vehicle drivers license ran it and given the information to the tow company for theft of service. is that going to hold water or render payment highly doubtful but it is recourse if a follow up tow occurs. Blocking vehicles in and demanding payment never ends well, it's best to avoid the confrontation as it can be seen as extortion in a court. Depends on the judge and how the law is written. Now, having watched the video. Check out the Attorneys video from from Today. She's concerned about Social Distancing. Really... Next, you'll hear the officer say that the tow company was not called and did not have the authority Here is the entire video from the attorney: So, in the end it was private property as stated by the officer. Such a Waste of Time, why involve an officer for $25 that's as bad as the _____ that did the commentary in the video. Oh, the incident was from April, 2020. I still thought that it would be a good topic of discussion. If you think different let me know and lets open a dialog cause different regions of the country may see this differently just as different Companies and Drivers deal with these situations differently. If this guy and his "emotionally tortured" 11 year old (according to Ms. lawyer lady ), had only stopped for mere minutes to walk their dog, how did the tow truck get there so incredibly fast? Was he posted up there, Just waiting on someone to park there? Doesnt really look like a big hot spot to me. I feel like they were there and out of their car for way way longer than the father is claiming. And to touch on that point, You are PARKED when the vehicle is in park and the driver leaves the seat. You are STANDING when the driver is in the vehicle, seat belt on and in gear. So, who walked the dog?? Did you let your obviously fragile 11 year old daughter walk off into the woods with the dog alone? The tow truck operator should have NEVER blocked that guy in. As much as I hate to agree with the cop-hating, hippie bozo commenting in the video, It is technically false imprisonment. and all of this over $25... He wasted half that sitting there idling his rig. Lastly, there were multiple "stabs" at one another between Auntie lawyer and the deputy.. The whole part the seas, moses motions by deputy tough guy then the demand of apology to the "frightened" 11 year old.. Just a matter of having the last word between the two of them in my opinion. If I was the Operator and was called there ( I dont patrol tow, EVER ), as long as I hadnt loaded or hooked it when the dog-walking man and his daughter showed up, I woulda cut them loose and been on my way. No point in arguing over a $25 show up fee.. I have better things to do.. As far as being towed away......I am in Michigan and well versed in my state’s ppi statutes but I know nothing about South Carolina’s so I cannot speak on that! Quote

Lucky the tables were not turned or the officer could have written the tow driver who was not hooked up to the vehicle. Should have just said this is a civil matter and given each of the drivers contact information. This is why we do few PPI's... Quote

No different than the impaired driver who is wronged when his or her car is impounded. I agree with Grumps however I don't feel that I would waste over 1/2 an hour for $25 along with my reputation.
