Ocala man jailed after allegedly threatening tow truck driver during repossession

 

An Ocala man found himself behind bars recently after tangling with a tow truck driver who was repossessing a vehicle.

 

A Marion County sheriff’s deputy responded to a residence in the 14100 block of S.W. 42nd Terrace Rd. and spoke with the owner of the vehicle and the tow truck driver, who were engaged in a verbal altercation. After the deputy got the situation under control, he spoke to both of the men about the situation, a sheriff’s office report states.

 

While the deputy was speaking to the tow truck driver, 23-year-old Dylan Miguel Martin – who was standing in the front yard of the residence – walked over to the tow truck and engaged the driver in a verbal altercation. A deputy heard Martin tell the tow truck driver, “I will knock your old ass out,” the report says.

 

The victim told the deputy that was he afraid because of the threat and Martin was then placed under arrest. He was transported to the Marion County Jail and charged with simple assault with intent/threat to do violence. He was released early Tuesday morning on $500 bond and his next court date hasn’t yet been set, jail records show.

Wow... forgive me, but maybe that guy shouldn't be doing repo's.  If I had a nickel for every jackwagon that made a threat to me while I was working, I'd have more than a few dollars' worth of nickels.  Not saying the guy making the threat wasn't in the wrong, but this is what comes with the territory.  Suck it up, pick your battles, let the ugly words roll off and deal with the genuine threats as needed.

I agree Richard, But on the other hand, By having the debtor arrested for verbally threatening him, The repo operator was then free to perform a uninterrupted reposession... Lol

Not only did Mr. Dumba$$ have to bail out, He will have to take the bus home..LMAO..😒😬🤨

I guess my take on it, having dealt with many ugly situations, and fortunately de-escalated -most- of them - is that if the debtor was truly a threat, there likely wouldn't be time for the police to respond.  It sounds to me as if it was a completely idle threat and the guy got the police involved for no legitimate reason.  If the car is hooked, then leave.  If it's not hooked, leave and come back later.

I can see it from your perspective Richard. Looking back, when I was doing repo work, I think I can recall maybe 4 times where the police got involved and they were all for property damage caused by the debtors (my truck ). I was a lot like you, Basically, I gave myself a 3-5 minute window. If I couldnt get the collateral out of the area where I picked it up from within that time without any altercation, then I left it and went back for it another time. I never saw the point in standing there and arguing with the debtor. ( most of the guys I worked with would do that )Especially in NY, There is a "breach of peace law" that supersedes any and all reposessors rights which, are slim to none to begin with. Basically, if law enforcement shows up while your performing a repo, You must release the vehicle back to the debtor and leave as to not "breach the peace" Even if you have the vehicle on a public street. The law used to be if you had possesion of the collateral and had it in a public street then it was yours regardless if the cops showed up or not. This law change was one of my reasons to get out of repo work. People used to ask me all the time if doing repo work was like on the shows, They would get disappointed when I explained how it wasnt like that in the real world and that if done right, it was pretty mundane work.
